Two things we tell you before you sue
Most people arrive wanting to know whether they are in the right. The more useful questions are what the cheaper route looks like, and what it costs you if the case goes the other way. We deal with both before anything issues.
Mediation offered, not just mentioned
Section 14 of the Mediation Act 2017 requires your solicitor to advise you to consider mediation before proceedings issue, and to swear a statutory declaration confirming they did. We run our own Med-Arb service, so that is a route we can put in front of you rather than a form of words on a declaration.
The costs you might lose, not just the ones you might win
Under section 169 of the Legal Services Regulation Act 2015, a party who is entirely successful in civil proceedings is entitled to an award of costs against the unsuccessful party, unless the court orders otherwise. That runs in both directions, and we say so before you commit — alongside the written notice of our own costs that section 150 requires.
